Smash Reaches Settlement With Universal in 'Fifty Shades' Suit

LOS ANGELES — Smash Pictures has reached a settlement with Universal  and Fifty Shades Ltd. in the trademark and copyright infringement lawsuit filed last year over the sale and distribution of the Smash parody “This Isn’t Fifty Shades of Grey XXX."

Smash Pictures will make a payment of a confidential sum to the parties and also will consent to a permanent injunction that will prohibit the distribution of the porn movie, according to a report Monday by The Hollywood Reporter.

Smash Pictures on Monday indicated they had no comment on the settlement.

Universal and its Focus Features division acquired the rights to make the "Fifty Shades of Grey" movie for $5 million in March 2012. Smash's parody, released last Fall, became a hot-selling adult movie. Along with Fifty Shades Ltd., the copyright owner of the original material, a lawsuit was filed in November that called the Smash's "XXX Adaptation" a "willful attempt to capitalize on the reputation of the book."

According to the Hollywood Reporter, the parties provided notice of settlement Friday and will be entering the terms of the injunction soon.
